In Australia there is the Spam Act 2003, read a detailed explanation of the Spam Act here. While your own definition of spam may vary, you don’t want your mail server to be refused due to spam reports, it would make business a little difficult.

We provide a service that complies with the Spam Act and does not put your mail server in jeopardy. Along with specific html code that pleases all mail applications we design for maximum effect. We also send a plain text version just in case your users don’t accept html.
